Rules for using AIRONEX.
Last Updated: 21 Sep 2026
These Terms of Service ("Terms") govern your access to and use of the AIRONEX website and the services provided by Marchend E-Marketing LLP, trading under the trade name AIRONEX ("AIRONEX", "we", "us" or "our"). By accessing this website, engaging our services, or otherwise indicating your acceptance, you agree to be bound by these Terms.
AIRONEX is the trade name and brand under which Marchend E-Marketing LLP, a limited liability partnership registered in India, offers website development, software development, web and mobile applications, CRM solutions, AI services, automation, digital marketing, consulting, maintenance, hosting and related digital services. AIRONEX is not a separate legal entity; all rights, obligations and liabilities described in these Terms rest with Marchend E-Marketing LLP.
By accessing this website, submitting an enquiry, signing a proposal, making a payment or otherwise using our services, you confirm that you have read, understood and agree to be bound by these Terms and any applicable proposal, quotation, statement of work or contract. Where you access the website or services electronically, your continued use, click-through acceptance, or performance of an act consistent with acceptance (such as making a payment) shall constitute valid acceptance of these Terms in accordance with the Information Technology Act, 2000 and the Indian Contract Act, 1872.
We provide, among other things, website and software development, web and mobile application development, CRM implementation, AI-enabled solutions, automation, digital marketing, consulting, maintenance, hosting, domain management, API development and third-party integrations.
The specific scope, deliverables and timelines for a given engagement will ordinarily be set out in a separate written proposal, quotation, statement of work or contract between Marchend E-Marketing LLP and the client, which shall take precedence over these Terms to the extent of any conflict.
Certain services may incorporate artificial intelligence, machine learning or automation tools, including those provided by third-party technology providers. AI-generated outputs are provided on an "as is" basis and may be inaccurate, incomplete or require human review before use. You are responsible for independently verifying any AI-assisted output before relying on it for business, legal, financial or other decisions.
You are responsible for providing accurate, complete and timely information, content, credentials, access and materials reasonably required for us to perform the services. Delays or defects arising from incomplete, inaccurate or late client materials may affect timelines and deliverables, and we shall not be liable for such delays to the extent caused by you.
Except as otherwise agreed in writing, all pre-existing intellectual property owned by Marchend E-Marketing LLP or AIRONEX — including our website, brand, logo, design elements, proprietary code, templates, frameworks, methodologies, internal tools and know-how — remains our exclusive property. Client-owned content, trademarks, data and materials remain the property of the client.
Ownership of, or any assignment of rights in, custom work created specifically for a client shall be determined by the applicable client agreement, project scope and full payment of applicable fees, and is not automatically transferred by these Terms.
Our services may involve or rely on third-party platforms, software, APIs, hosting providers, payment gateways, AI providers or other services. Such third-party services are governed by their own terms and privacy policies, and we do not control and are not responsible for their availability, performance, security or content.
Fees, invoicing schedules, taxes, applicable third-party costs (such as hosting, domains, APIs or software licences) and payment terms will be set out in the applicable quotation, proposal, invoice, statement of work or agreement. Payments are subject to applicable Indian tax laws.
Any refunds, if applicable, shall be determined on a case-by-case basis in accordance with the applicable agreement and are not governed by a fixed or automatic percentage under these Terms.
Changes to project scope, additional features, revisions beyond the agreed scope, or new requirements raised after project commencement may be treated as additional work and may be subject to additional fees and revised timelines, as agreed between the parties in writing.
We aim to keep this website and, where applicable, hosted client services available and functioning properly, but we do not guarantee uninterrupted, error-free or continuous availability. Access may be suspended for maintenance, upgrades, security reasons or circumstances beyond our reasonable control, including force majeure events.
You must not use our website or services for any unlawful purpose, to infringe the rights of others, to transmit malware or harmful code, to attempt unauthorised access to any system, or in any manner prohibited under applicable Indian law, including but not limited to the Information Technology Act, 2000. See also our Content & Acceptable Use Policy.
Our website and services are provided on an "as is" and "as available" basis. To the extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, save to the extent such disclaimers are not permitted under applicable law.
To the maximum extent permitted by applicable law, Marchend E-Marketing LLP (trading as AIRONEX) shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, business or goodwill, arising from or related to your use of our website or services.
Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is prohibited by applicable law.
You agree to indemnify and hold harmless Marchend E-Marketing LLP, trading as AIRONEX, its partners, employees and representatives from and against claims, losses, liabilities and expenses arising out of your breach of these Terms, misuse of our services, or violation of applicable law, to the extent permitted under applicable law.
We may suspend or terminate access to our website or services where we reasonably believe these Terms, an applicable agreement, or applicable law has been violated, or where continued provision of services is not commercially or operationally feasible, subject to the terms of any applicable written agreement.
We may update these Terms from time to time to reflect changes in our services, legal or regulatory requirements, or operational practices. The "Last Updated" date at the top of this section indicates when these Terms were last revised.
